TERMS OF SERVICE

The use of SPAM to generate referrals is strictly prohibited. Any member deemed to be spamming or sending UCE (Unsolicited Commercial Email) will be thoroughly investigated. All evidence gathered will be turned over to the proper authorities, their Internet Service Provider, and possibly others. This may result in any of the following to the offending member: Termination of their LinkTwister Slip Down Banner Exchange Account (no refunds!) Termination of their STORMPAY, PayPal, SolarPay, E-Gold Account (and loss of all funds within) Termination of their E-Mail / Internet Account Possibility of class-action lawsuits (Spam is illegal in most States and Provinces).

General rules: Members of LinkTwister Slip Down Banner Exchange agree to the following terms and conditions. Anyone found in deliberate violation will be subject to being banned from this exchange.

ONLY ONE free account per household.
Must be over the age of 19.
If you cancel your account before commission date, you will NOT receive commission or rewards.
No illegal, Warez, hate or adult related contents with banners or link sites.
Banner being displayed through our system can not be more than 20Kb is size.
Banners must load in under 10 seconds on a 56K connection.
NO more than one banner per page and all banners must be placed in the top half of a page of a 800X600 screen.
Breach of rules will result in account removals, loss of referral commissions, compensation and contest rewards.
You must login to your account once every 15 days or your account and or champagnes will be deleted without notice.
Any account with no credits in the account will be deleted after 90 days.
Any bounced, returned, over quota emails and your account will be deleted.
Traffic Loops: Will not be tolerated.
We reserve the right to accept or deny your champagne, banner or site at our discretion.
We reserve the right to change or add to our rules at anytime.

The Referral Program
By becoming a member of LinkTwister Slip Down Banner Exchange, You will be given an opportunity to refer other people ("Referrals") to the Service and/or Programs. You and Referrals will become users of the Service and/or Programs, (subject to this Agreement and our Privacy Policy and Anti-Spam Policy) and You will be credited for Referrals You make and for the Referrals they make. You understand that You will only be credited up to six levels of the Referrals, that is first level will be Your primary Referrals, Referrals directly referred by You, and six levels of secondary Referrals, Referrals that Your Referrals will make and so forth up to and not exceeding five levels from your initial first level on a monthly basis for current referrals and not for any referrals that have had there account removed or deleted.

-You may not obtain Referrals by Spamming.

-You may not make any misrepresentations to any of Referrals or potential Referrals about Service and/or Programs, with respect to compensations or benefits received by our members, or with respect to compensations or benefits that potential Referrals will be eligible to receive. You agree to comply with all applicable laws related to multi-level marketing programs.

Gold members will receive automatic referrals into there downline. These are new members that have not been referred by any existing members.

The Credit Withdraw Program.
The CPM (Credits per thousand) rate is a variable rate. The rate is automatically adjusted by our system. You will not receive compensation of any type if you have violated our terms of agreement, your account has been cancelled by our support staff or automatically.

This program is for novelty purposes only. A member can win Credits to use for this program only. No Guarantee implied or given with this program.

Gold Member Lotto Shares:
A portion of every gold membership is used to purchase Lotto Tickets in Ontario, Canada. There is no Guarantee of winning. We reserve the right to cancel this program at any time. All funds paid out will be in Canadian Funds or will be converted into US funds at the given rate at that time. Any funds won will be distributed as follows:

Any amount under $50.00 will be used to purchase tickets.
Any amount between $50.01 to $500.00 will be distributed to Gold members as an equal share between the members minus a two percent plus $0.30 charge (2%+$0.30). *All funds will be paid by PayPal.
Any amount between $500.01 to $5000.00 will be distributed by Company cheque, money order, direct transfer, PayPal, or any other method deemed suitable at that time by LinkTwister Slip Down Banner Exchange or it's owners to Gold members as an equal share between the members *minus a two percent plus method of payment charges if any(2%+$?).

Members agree to include the full unmodified HTML code provided by LinkTwister Slip Down Banner Exchange for displaying ads on their web site, in as many or few pages as they wish. A member may not artificially inflate traffic counts to his or her site using a device, program, or other means. A member may not display more than one LinkTwister Slip Down Banner Exchange banner on any page. (Note: It is easy for us to tell when someone is abusing the system because we keep an IP log of all views. Those who attempt to artificially inflate traffic counts will be banned without warning.)
Members are only allowed to have one account per IP address.
All members must be over the age of 19.

LIMITATION OF LIABILITY:

You agree that our entire liability, and your exclusive remedy, with respect to any Services(s) provided under this Agreement and any breach of this Agreement is solely limited to the amount you paid for such Service(s). We and our contractors shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of the Services or for the cost of procurement of substitute services. Because some states (Provinces) do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states (Provinces), our liability is limited to the extent permitted by law in the province of Ontario, Canada. We disclaim any and all loss or liability resulting from, but not limited to: (1) loss or liability resulting from access delays or access interruptions; (2) loss or liability resulting from data non-delivery or data miss-delivery; (3) loss or liability resulting from acts of God; (4) loss or liability resulting from the unauthorized use or misuse of your account identifier or password; (5) loss or liability resulting from errors, omissions, or misstatements in any and all information or services(s) provided under this Agreement; (6) loss or liability resulting from the interruption of your Service. You agree that we will not be liable for any loss of registration and use of your domain name, or for interruption of business, or any indirect, special, incidental, or consequential damages of any kind (including lost profits) regardless of the form of action whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such damages. In no event shall our maximum liability exceed ten ($10.00) dollars.
ENTIRETY. You agree that this Agreement, the rules and policies published by us are the complete and exclusive agreement between you and us regarding our Services. This Agreement supersedes all prior agreements and understandings, whether established by custom, practice, policy or precedent.
INFANCY. You attest that you are of legal age to enter into this Agreement.

Guarantee:
We will issue a refund to you if you are not satisfied with our paid services. The refund period lasts for 2 days after sign up. We can only refund the money you have paid to us minus any account fees and credits at pro rata rates.

Membership Cancellation Voluntary and Automatic:

You may cancel your membership at any time by using the contact Form located at LinkTwister Slip Down Banner Exchange or your membership will be canceled automatically if you do not login in to your account for more than 1 (One) Month.

You understand that by canceling your membership by using the contact Form or automatically canceling your membership by not login into your account for more than 1 (One) month, you will lose all your balance on the account and downline. You understand that if you decide to join LinkTwister Slip Down Banner Exchange in the future you might have a different User ID, and you will not get your balance back or regain your downline.

Case of dispute:
Affiliates/members/advertisers agree to settle any/all dispute(s) under this agreement via binding arbitration in Toronto, Ontario, Canada

DISCLAIMERS:

Upon signup, you are given a Member ID and Password to access our Members-only area. Each login is stored in our database with the IP Address of the computer logging in. We monitor all accounts, and if it is determined that you have shared your Member ID and Password with someone else, or if your have multiple accounts your account will be immediately terminated and you will lose all balances in your account and downline.
We reserves the right to E-Mail all of our members with updates and notices about our program at any time.
Other members can E-mail members using our safe-list sender only.
We reserves the right to modify these terms and conditions, without notice to our members, at any time.
We reserves the right to discontinue our service, with ample notification to all members, at any time.
We will issue a refund to you if you are not satisfied with our pro member service at a pro rata for the credits used. The refund period lasts for 2 days after sign up. We can only refund the money you have paid to us minus any account fees, and not your Sponsor's. You will have to contact your sponsor for a refund from them if applicable.
We cannot guarantee any amount of hits to your site, nor the clicks on your banners. Some do better than others.
ACCEPTANCE OF AGREEMENT. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, SHORT TERMS OF SERVICE AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT., GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
